Terms and Conditions

Please read these Terms and Conditions ("Terms") carefully before using Built Story (the "Platform"), operated by Built Story, LLC ("Built Story," "we," "us," or "our"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

1. Acceptance of Terms

By creating an account, accessing the Storyboard, posting content, placing bids, or otherwise using any feature of the Platform, you acknowledge that you have read, understood, and agree to these Terms and our Privacy Policy, which is incorporated herein by reference.

2. Description of the Service

Built Story is an online marketplace and deal-sharing network that connects licensed real estate brokers ("Brokers") with vendors and advertisers ("Vendors"). Brokers publish deal listings ("Posts") to a shared feed called the Storyboard. Vendors may bid to have promotional content ("Ads") displayed within that feed through a pay-per-placement auction system.

3. Eligibility

Brokers: To register as a Broker, you must hold an active real estate license issued by a U.S. state licensing authority. You are required to provide a valid license number and issuing state during onboarding. By submitting this information, you represent and warrant that it is accurate and current. We reserve the right to verify your license and suspend or terminate your account if your license is inactive, expired, or cannot be verified.

Vendors: To register as a Vendor, you must be a legal business entity or individual authorized to enter into binding contracts. Vendor registration requires agreement to our Vendor-specific terms (Section 9).

General: You must be at least 18 years of age to use the Platform. By using the Platform, you represent that you meet all applicable eligibility requirements.

4. Account Registration and Security

You agree to provide accurate, complete, and current information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at support@builtstory.com if you suspect unauthorized access to your account. We are not liable for any loss or damage arising from your failure to safeguard your credentials.

5. Email Verification

Accounts registered with an email address and password are required to verify the email address before accessing certain features. Failure to verify your email may result in restricted access to the Platform until verification is complete.

6. Broker Terms

6.1 Content You Post

By submitting a Post to the Storyboard, you grant Built Story a non-exclusive, royalty-free, worldwide license to display, distribute, and reproduce that content on the Platform for the purpose of operating the service.

You are solely responsible for the content of your Posts. You represent and warrant that:

  • You have all rights necessary to submit and share the content;
  • The content does not violate any applicable law, regulation, or third-party rights;
  • The content is truthful, accurate, and not misleading;
  • The content does not include confidential client information without proper authorization.

6.2 Prohibited Post Content

You may not post content that:

  • Contains false, misleading, or fraudulent deal information;
  • Violates fair housing laws or any anti-discrimination regulations;
  • Infringes any copyright, trademark, or other intellectual property right;
  • Includes personal data about third parties without their consent;
  • Is defamatory, harassing, obscene, or otherwise unlawful.

6.3 Post Moderation

We reserve the right, but have no obligation, to review, remove, or restrict any Post at our sole discretion, including for violations of these Terms or our content policies.

7. Storyboard and Feed

The Storyboard is a shared deal feed visible to registered Brokers. Sponsored placements (Ads) from Vendors may appear within the Storyboard feed. The presence of an Ad does not constitute Built Story's endorsement of the Vendor or their products or services.

8. File Uploads

You may upload files (such as images and documents) when creating Posts. You are responsible for ensuring that uploaded files do not contain malicious code and do not infringe third-party rights. We reserve the right to remove any file at our discretion.

9. Vendor Terms

9.1 Ad Creation and Submission

Vendors may create Ads, set a bid amount ("Budget Per Post"), select a target market region, and choose a display frequency. By submitting an Ad, you represent that it complies with all applicable advertising laws and regulations, and that you have all rights necessary to publish the Ad content.

9.2 Ad Auction

Ad placements in the Storyboard are determined by an automated auction. Ads are ranked by bid amount per market region. Built Story does not guarantee that any Ad will win a placement. Auction results depend on competing bids and your payment method being successfully charged at the time of the auction.

9.3 Charges and Billing

You authorize Built Story to charge your payment method on file (processed via Stripe) each time your Ad wins a placement auction. Charges are per successful placement. There are no subscription fees; you are only charged for successful auction wins. All charges are final unless otherwise required by law or expressly agreed by Built Story.

You are responsible for ensuring your payment method remains valid. If a charge fails, your Ad may be passed over in the current auction cycle. Built Story is not responsible for missed placements due to payment failures.

9.4 Stripe

Payment processing is provided by Stripe. By adding a payment method, you agree to Stripe's Terms of Service. Built Story does not store full payment card details.

9.5 Ad Statuses

Your Ad may be placed in draft, active, paused, inactive, or quarantined status. A quarantined status may result from policy violations or fraud signals. You may appeal a quarantine by contacting us.

9.6 Prohibited Ad Content

Ads must not contain false or misleading claims, violate any applicable advertising standard, or promote illegal goods or services. We reserve the right to reject or remove any Ad at our sole discretion.

10. Prohibited Conduct

You agree not to:

  • Use the Platform for any unlawful purpose;
  • Attempt to gain unauthorized access to any part of the Platform or other user accounts;
  • Scrape, crawl, or otherwise extract data from the Platform without our express written consent;
  • Interfere with or disrupt the integrity or performance of the Platform;
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
  • Use the Platform to transmit spam, unsolicited messages, or malicious code;
  • Circumvent any technical measures we use to provide or protect the Platform.

11. Intellectual Property

Built Story and its licensors own all intellectual property rights in the Platform, including the software, design, branding, and aggregated data. Nothing in these Terms transfers any ownership rights to you. The "Built Story" name, logo, and taglines are trademarks of Built Story, LLC.

Your content remains yours. You retain ownership of Posts and Ad content you submit, subject to the license granted to us in Section 6.1.

12. Privacy and Data

Your use of the Platform is subject to our Privacy Policy. We collect and process personal information (including real estate license data, contact information, location, and billing details) as described therein. By using the Platform, you consent to such collection and processing.

For California residents, please see our CCPA disclosures in the Privacy Policy. You may request deletion of your account and associated data through the account deletion request feature or by contacting us.

13. Third-Party Services

The Platform integrates with third-party services including Google Maps, Stripe, and Amazon Web Services. Your use of features powered by those services is subject to their respective terms and privacy policies. Built Story is not responsible for the practices of these third-party providers.

14. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE MAKE NO REPRESENTATIONS REGARDING THE ACCURACY OR COMPLETENESS OF ANY CONTENT ON THE PLATFORM, INCLUDING BROKER POSTS.

BUILT STORY IS NOT A REAL ESTATE BROKER, AGENT, OR ADVISOR AND DOES NOT PROVIDE REAL ESTATE ADVICE. THE PLATFORM IS A COMMUNICATIONS AND NETWORKING TOOL ONLY.

15. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BUILT STORY, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, GOODWILL, OR DATA, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO BUILT STORY IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

16. Indemnification

You agree to indemnify, defend, and hold harmless Built Story and its affiliates from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • (a) your use of the Platform;
  • (b) content you submit;
  • (c) your violation of these Terms; or
  • (d) your violation of any applicable law or third-party right.

17. Termination

We may suspend or terminate your account at any time, with or without notice, for any violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to access the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination (including Sections 11, 14, 15, 16, 18, and 19) shall survive.

You may delete your account at any time through the account settings or by contacting us.

18. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of [Your State], without regard to conflict-of-law principles. Any dispute arising under these Terms shall be resolved by binding arbitration administered under the rules of the American Arbitration Association, except that either party may seek injunctive or equitable relief in a court of competent jurisdiction. You waive any right to participate in a class action lawsuit or class-wide arbitration.

19. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting a notice on the Platform or by email. Your continued use of the Platform after the effective date of the updated Terms constitutes your acceptance. If you do not agree to the revised Terms, you must stop using the Platform.

20. Miscellaneous

Entire Agreement: These Terms, together with the Privacy Policy and any Vendor-specific agreements, constitute the entire agreement between you and Built Story regarding the Platform.

Severability: If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force.

No Waiver: Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision.

Assignment: You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights freely.
